Exhibition Guidelines
Dear Artist,
COLORSxSTUDIOS GmbH, of Nalepastrasse 18, 12459 Berlin, Germany (“COLORS”) will present an exhibition of artworks during the so-called “COLORS á PARIS” event in Espace Niemeyer, Paris, on the date of 28th November to 2nd December, 2022 (“EVENT”). By completing the Exhibition Form, you agree that you are an exclusive author / owner of original artworks (“ARTIST”).
The Exhibition Form will open on 3rd November 2022 and close on 15th November 2022.
During the EVENT, COLORS will present an exhibition of several artworks (“EXHIBITION”). ARTIST is the author / owner of original artwork (e.g. photo, painting, video, poem, etc.) that they exclusively own (“ARTWORK”). ARTIST herewith agrees to submit and license the ARTWORK(S) for the EXHIBITION free from any third party’s rights and free from costs to COLORS. The ARTWORK must be submitted to COLORS in a digital format (e.g. jpeg, mp4, etc).
ARTIST herewith agrees that COLORS shall be entitled to publicly exhibit the ARTWORK. This shall take place in the following form: e.g. photographic works may be printed to be displayed, poems/stories may be printed and may also be translated to be displayed and film works may be projected and / or performed. The rights in the ARTWORK granted to COLORS shall include but are not limited to, the right to reproduce, modify and edit (only for the purposes of reproduction e.g. resizing a jpeg image), translate, exhibit, present, perform, and communicate the ARTWORK to the public during the EXHIBITION. Furthermore ARTIST agrees that COLORS can use your name / likeness and any other information provided in the Exhibition Form (e.g. social media handle, age, exhibition label, etc, only if provided) in connection with the ARTWORK and EXHIBITION.
COLORS may make ARTIST’S ARTWORK available on their website and any other media in connection with any publicity of the EXHIBITION. Therefore ARTIST herewith grants COLORS a non-exclusive, worldwide, irrevocable cost-free license, for the full period of any intellectual property rights in the ARTWORK and any accompanying materials, to use, display, publish, make available, transmit, copy, store, and re-format the ARTWORK for such purposes.
The EXHIBITION is not for the intention of the sale of ARTWORK and COLORS shall not advertise the EXHIBITION or allow for any sale as such. Notwithstanding the foregoing ARTISTS may of their own accord provide details of ARTWORKS to facilitate sales via their independent dedicated channels.
For the avoidance of doubt, it is set out that the ownership of the original ARTWORK and the copyright therein shall remain vested in the ARTIST. No rights in the ARTWORK, other than those herein licensed, shall be exercised by COLORS.
COLORS shall respect and observe the ARTIST’S moral right of paternity (the right to be identified as the author of the work) and integrity (the right to preserve the work from derogatory mutilation and distortion).
By completing the Exhibition Form, ARTIST guarantees that they are the only author / owner of the original ARTWORK, that all rights in the ARTWORK are vested exclusively in the ARTIST, the ARTIST has full right and authority to license the ARTWORK and that the use of the ARTWORK in the manner set out in these Guidelines and the rights granted will not infringe the rights of any third party e.g. (e.g. any author, music publisher, record label, collection society, etc). Therefore ARTIST shall indemnify COLORS and its partners from any infringement and / or claims of any third party’s rights in the ARTWORK (e.g. using uncleared music for a film/dance video etc).
COLORS reserves the right to change the specified date of the EXHIBITION but will endeavor to ensure the date promoted is the one in place.
COLORS reserves the right to not exhibit a submission of ARTWORK without notice to ARTIST. This does not affect your statutory rights.
COLORS does not accept responsibility for ARTWORK submissions that are lost, delayed, or corrupted, or due to computer, network or software failure which may restrict, delay or failure of submission.
If, at any point, after ARTIST’S submission of ARTWORK and before the date of the EXHIBITION, ARTIST decides to retract the submission, ARTIST must contact COLORS at parisconnect@colorsxstudios.com with the request to terminate the license of ARTWORK. COLORS shall oblige the request and destroy any reproductions made.
Upon written request at parisconnect@colorsxstudios.com any reproduction of ARTWORK made for the EXHIBITION may be collected by the original ARTIST after the final date of the EVENT at the ARTIST’s own responsibility and expense. If no known request is made by ARTIST to COLORS by the final date of the EVENT or COLORS cannot facilitate the request upon COLORS final discretion, COLORS may, without notice to the ARTIST, destroy or archive all other reproductions made upon completion of the EVENT. In the event that an ARTIST’s ARTWORK is archived, COLORS will use reasonable efforts to contact ARTIST regarding the possible future usage of the ARTWORK.
COLORS will only process your personal information as set out in the Privacy Policy.
COLORS reserves the right, from time to time, with or without notice, to change these Guidelines at COLORS sole discretion, and the latest version will appear on the Exhibition Form with the date that it was last updated.
Amendments and supplements to these Guidelines must be made in writing.
Should any provision of these Guidelines be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall then be replaced by a legal provision which comes as close as possible to the invalid provision.
If there is any reason to believe that there has been a breach of these Guidelines, COLORS may, at its sole discretion, reserve the right to exclude you from participating in the EXHIBITION.
All data obtained from ARTIST by COLORS in connection with these Guidelines shall be stored by COLORS in line with the GDPR.
These Terms shall be governed by German law and the place of jurisdiction shall be courts of Berlin.
